There needs to be a way for UK Cycling to compile this and work with other organisations who share these concerns and start a campaign of lobbying MPs.

Widely reported nationwide this horrific incident occurred on the A34 very local to me....

Got 10 years for each count of causing death by dangerous driving to run concurrently. So kill one person you get 10 years, kill four people you still effectively get 10 years. Almost as if the other lives don't matter at all. He'll be out in five.

(He also got a seven year driving ban. Plus another four years (also to run concurrently) for causing serious injury to another person.)

EDIT :- story updated today. Driver claimed his brakes had failed until he was confronted with his own dash cam footage which showed him distracted by his mobile phone.

£5000 fine for and 5 points for Michael Heseltine for careless driving that caused serious injury to cyclist.

The particular road where this incident happened is a notorious racetrack for motorcyclists,particularly at w/ends,and this particularly nasty piece of work of a man that caused David Hitchen's death has got off far too lightly.
10years would've been nearer the mark given his previous appalling driving record :twisted: :twisted: :twisted: .

Is there any reasoning avaiaalble as to why the sentencing judge would award only 6 month sentence for a death by careless driving - I looked this up in the sentencing guidelines on death by careless driving https://www.sentencingcouncil.org.uk/of ... e-driving/

Maximum when tried summarily: Level 5 fine and/or 6 months
Maximum when tried on indictment: 5 years

What is the difference in being tried summarily and on indictment? Was this guy tried summarily therefore judge can only give max of 6 mths? Who/Waht decides whether someone is tried summarily or on indictment?

I do think that people's lives are more important than a motorist retaining his/her's driving licence. We have had police in unmarked vehicles recording the antics of morons using mobile phones, after seeing the carnage caused in many FATAL incidents. The police even saw an idiot eating cereal whilst driving on a motorway. These idiots should be banned for life. There is a desperate need for marked police cars patrolling motorways, as the standard of driving is atrocious and bloody dangerous. It seems that nowadays, it is too much of an effort to use the traffic indicators, after all, you have to put so much effort into moving the indicator stalk. Another of my pet hates is the driver in the fast lane, with 100 yards to go, slamming across 2 lanes of traffic to take the slip-road. I suppose with air-bags, seat-belts etc. these stupid people think they are immortal. Don't think I am anti-motorist, I have survived more than 60 years on the roads, cyclist, motor-cyclist, and motorist for 55 years. It really scares me when I see the antics of the irresponsible cretins on the roads today, and it gets worse every year. We have just had the first foggy day and as I predicted early this morning, there were many accidents!

This one seems very low indeed given the circumstances and the judge's comments. Overtaking in heavy fog head on collision with a 19 year year old girl travelling to work on her moped. Yes she was wearing hi viz, yes she had her lights on. Two years, four year ban and an extended driving test.

You can fit mirrors and CCTV to a lorry to eliminate blindspots but you can't make the driver look.

Magee, of Readers Court, Chelmsford, Essex, denied causing death by dangerous driving and his plea to causing death by careless driving was accepted.

“Mrs Phipps was there to be seen by you in either your mirror or on-board CCTV. You could have seen her at all points leading up to and during the collision, whether there were blind spots or not. You parked in a dangerous position. This disaster would have been avoided. You chose not to look into the monitor on most occasions. Thus, you didn’t use it on this occasion when you ploughed into this lady cyclist. That is complete folly.

I find this was indeed a terrible and irresponsible course of conduct. It led to the unnecessary death of another road user. I find you behaved irresponsibly with your lorry from the moment you arrived in Teynham.”

The judge added there had to be severe punishment.


He was jailed for three years and banned from driving for five-and-a-half years.

^ Absolutely disgusting,if that wasn't dangerous driving I wonder what constitutes it.
The penalty is wholly inadequate and lenient IMHO :twisted:
