The offer will be "in full and final settlement" of your right to compensation arising out of the incident. That means you would not be able to claim for anything else later on. Ye my elbow still gives me grief when I apply pressure to it feels a bit lumpy and grindy when I move my fingers over it but with covid I'm reluctant to go to docs or for medical but your point is a very good one. I did know about final settlement but 5k seems fair Evan if there is some lasting damage, and if it turns out it's nothing they might offer less?(unsure of that)

Ye I was also surprised, I would of been happy with £500. Solicitors want me to go have medical and keep it going but I'm ending it as it is a good offer.

Update solicitors have been in touch the farmers insurance company have offered £5,000 to settle I have accepted thanks to everyone for their input.

Hi been waiting for solicitor, they have admitted liability, so got to send them details of what expenses I have incurred.

Penalty for placing rope, etc. across highway.
A person who for any purpose places any rope, wire or other apparatus across a highway in such a manner as to be likely to cause danger to persons using the highway is, unless he proves that he had taken all necessary means to give adequate warning of the danger, guilty of an offence and liable to a fine not exceeding [F79level 3 on the standard scale].

Sorry to hear this, they shouldn't be taking 35% of what you get, they should be adding their costs to the total claim.
Remember you must also claim for additional costs, so that taxi journey to work etc., can be included in your claim along with any additional expenses you have due to not having your first means of transport that can be directly attributed to the accident.

Hi thanks, ye up to 35% I think they said that's why I hope it's quick so minimum should be taken .

I tried to keep it from legal action, but I now have no means of transport to get to work as my brakes are not working properly and it's 10 mile ride partly in the dark with 1000m accent/decent, had to get taxi this morning, bike shops are full in my area till end of October and getting it to them is going to be tricky, I want them to examine it and list what's wrong. I work 60 hours a week and have 3 kids when I'm not in work, this is why I employed a no win no fee solicitor, yes they will take up to 35% of whatever I get but I figure they will want to settle long before court for such a small amount. This has totally stressed me out couldn't sleep last 2 nights thinking about it all and aches and pains ment I couldn't get comfortable.

Someone putting another perspective may appear 'one-sided', perhaps. It is alarming to hear someone who consults no-win, no-fee lawyers who will bleed them of anything they might win - seemed to me that another perspective might have been helpful. It's clearly unwelcome, so I wish you every success in your action for 'compo'. Take good advice, and go carefully on those lanes in the half-light.

I realise compo is a horrible word and as I said this was my last resort as I tried to reason with them. I appreciate all your input sorry if I reacted negatively towards it, peace.

Who else has encountered rope across the road in the dark with no warning... Did you see it and stop with ease your perspective seems one sided as no one expects rope across a road anytime of the day, to say I wasn't in control is unfair. It's not just 300 pound that was a guess, 1 day off work is 150 pound new brakes are prob 150 front and back my waterproof jacket was 100 pound trousers 30 how much is a new Yamaha computer and labour on top. Compensation is to fix my bike and replace my clothes as I wouldn't accept his half offer, plus day off work today as my body aches all over and my knee really hurts when I bend it. As I said how can I trust he will evan pay half once I have it fixed, also he doesn't want to contribute to anything else only the brake repair replace. You say they will ask for 50/50 as I understand it is iligal to put anything across the road as it endangers life so how is that half my fault. I'm not doing it for monitory gain just to ensure my stuff is replaced, I gave them the chance to do the right thing. I will inform the police also as I don't want this to happen to anyone else hopefully he will then get correct hi Vis signs to warn people of dangers. Thanks for everyone's input

Ye not that bad injuries wise but he didn't end up in a pile of cow muck, mud and water ive ugot in touch with accident solicitors there happy to persue a no win no fee not what I wanted to do but feel I have no choice as they think it's acceptable practise and angered me by saying it was my fault for not seeing it
