A quick look at the info box shows that the photograph was taken in Spain.
Which I seem to recall compels you to wear helmets under certain conditions but not under other conditions. So I guess they felt free from compulsion when the photo was taken.

Also you can look up the individual on the front of the bike and see that he doesnt seem to wear a helmet often when cycling.

My 'risk assessment' is most likely inaccurate, but it's what I'm comfortable with and I take the same approach for many other things in my life e.g. speed of approach at a corner, going down steep hills, taking the country lane or 'A' road.... and so on :wink:
