I don't know if they're used for prosecutions in UK, but they're insisted on by some insurance cos, mainly for young people (insurance cos idea of young). In USA and some other parts they are fitted quite routinely to all manner of vehicles and are accessed by police after a crash. They could technologically be used for investigation, prosecution and even control (cf speed limiters); like so many things, the technology is there, the will is lacking.
