You say it's a byway, in which case it's open to all traffic - assisted, married or not. Even rude people are allowed to use it.

Or maybe you mean restricted byway? That's a more interesting question.

Here's one opinion I found:

E-bikes can be exempted from being classed as a ‘powered transporter’ if they meet certain criteria, including:
they must be fitted with pedals which can propel it;
the maximum power for the motor must not exceed 250 watts; and
the electrical assistance must cut out at a limit of 15½ miles per hour (25 kilometres an hour).

In other words powered cycles or L1e-A vehicles (see Article 4, 2(a)i !) as the UK & EU defines them.

Depending on the tandem spec, it may or may not be legal. Let's be generous and assume they're riding a L1e-A- compatible tandem, eh.

Totally irresponsible to my mind...... No helmets either!

I do not think their activities wil need a helmet,though some cyclists like to surprise their husbands.
