In the six seconds before impact, the self-driving system classified the pedestrian as an unknown object, then as a vehicle, and then as a bicycle, a preliminary report from the National Transportation Safety Board explained. While the system identified that an emergency braking maneuver was needed to mitigate a collision, the system was set up to not activate emergency braking when under computer control. "

A system which drives 99 .9% of the time but relies on a human in an emergency is never going to be safe.

To be honest, that doesn't mean a great deal.

That really only means that the company has not been found to be intentionally reckless or criminally negligent.

They will almost certainly still be held liable for the death, damages, and associated costs.

The National Safety Transportation Board is still investigating, and will certainly require Uber to take some corrective & preventive actions when they have concluded. They have issued a preliminary report https://www.ntsb.gov/investigations/Acc ... prelim.pdf

The irony is that if the Uber self driving system didn't disable Volvo's safety systems the death would most likely have been avoided.
As the report says
"The vehicle was factory equipped with several advanced driver assistance functions by Volvo Cars, the
original manufacturer. The systems included a collision avoidance function with automatic emergency
braking, known as City Safety, as well as functions for detecting driver alertness and road sign
information. All these Volvo functions are disabled when the test vehicle is operated in computer control
but are operational when the vehicle is operated in manual control."

Volvo say this about their City Safety system
"Cyclists crossing the path of the car or suddenly swerving out in front it. Depending on the situation, City Safety is able to avoid a collision if the relative speed difference is up to 45 km/h. At higher speeds, the automatic braking can mitigate the consequences of the collision."
