A jury at Canterbury Crown Court had failed to agree whether or not Penfold, 21, had been driving dangerously when she caused the fatal accident.

Crown prosecutors have since decided they will not be asking for a second trial after she had earlier pleaded guilty to a lesser charge of causing death by careless driving.

Penfold had been driving her car when she overtook two vehicles on the A2070 in May last year, but she failed to spot the cyclist coming in the opposite direction.

Yet another disgusting outcome, the jurists who did not agree with her being guilty of dangerous driving after being able to see the person she killed for 45 seconds should hang their heads in shame, the judge is simply a moron and not fit for purpose.The so called justice system is clearly also not fit for purpose that allows this travesty of justice as it has done on so many occasions, it's a complete mockery when you have people who clearly are not able to adjudge motoring cases as they for the most-part are inherently bias/unable to see the wrong from the outset because they are motorists themselves and too often see no wrong in the actions taken because they themselves would be as likely to make the same errors. :twisted:
But yeah, let's have more up to date laws for people on bikes, if this was a non motoring case and so it'd be manslaughter I would think the outcome would be different.

Not sure this has been previously covered but nevertheless.

About a week or so ago on my local TV news BBC Look North there was a solicitor calling for more lenient sentences for those living in rural communities apprehended for drunk driving. His thinking was, somewhat perversely in my opinion, was that due to the demise of public transport any potential driving ban would have a greater detrimental affect than those convicted of a similar offence in an urban environment. I have tried to find a link for the article over the last few days but to no avail.

However whilst endeavouring to find aforementioned article my search threw up dozens if not hundreds of links to legal and Para-legal firms within the UK whose specialism sadly seems to be dealing with drunks using motor vehicles.

Now if we are to consider that the supply of a particular commodity or service reflects the demand for such a service per se; are we to assume that although the conviction rate for drunk driving has fallen, it’s incidence may be more pronounced than perhaps the “official” figures reveal?
Just remember, when you’re over the hill, you begin to pick up speed. :lol:

Bradbury, of Balmoral Drive, Sleaford, admitted three charges of causing serious injury by dangerous driving on September 10, 2017.

He was jailed for three years and nine months, banned from driving for three years and must take an extended driving test.

Allison got was it 18 months because he could not stop because a pedestrian walked out in front of him

Benbow was banned from driving for 12 months and will have to retake his driving test after the disqualification period.

I occasionally do Grandad's airport taxi service and I'm irked by a lot of the exhorbitant charges but road rage is hardly the answer. FWIW, I fancy that for a person of good character, a suspended sentence is within sentencing guidelines here but it's wrong for a judge to use their privileged position to air their personal views about things like airport parking charges.

Astonishing! The airport worker could have been killed. If the defendant had thrown a punch at the victim (instead of driving at him with a car) I suspect he would have received a higher sentence. Our legal system (where leniency is shown towards dangerous motons) just stinks!

Exorbitant? I thought: GBP 20 maybe, read the article, GBP 3 is not much, the price of a short bus journey, anyone agree?

Driver one: doing 46-52mph in 30mph pedestrian area with lots of shops and pedestrians at all hours (Streetview: https://goo.gl/maps/7qt2w9Uq33B2)
Driver two: NQD pulled out on driver one, causing collision, both cars mount pavement, kill pedestrian

Outcome:
driver 1 12 month suspended sentence, 180 hours community service, 4 month curfew, 3 year driving ban
driver 2 6 month suspended sentence, 140 hours community service, 3 month curfew, 3 year driving ban
