There are also, of course, the National Park 's legal fees. For the appeal they were crowdfunded via the Dartmoor Preservation Society. Maybe the Darwalls are betting on the National Park running out of cash before they do. To be clear, the landowners are not appealing to the Supreme Court, they are applying to the Supreme Court for permission to appeal.
The decision of the Court of Appeal was unanimous. I think that otherwise or if the Court of Appeal had determined that there was an important point of law which it would be appropriate for the Supreme Court to hear and rule upon, the Court of Appeal would itself have granted leave to appeal to the Supreme Court.
It would seem therefore that the odds are probably against permission to appeal being granted.

Against, I think, the general expectation, the Supreme Court has today agreed to hear the appeal. Date to be fixed.

When the landowner won the initial hearing at the High Court, Labour said it would pass legislation to legalise wild camping in all the national parks. It subsequently rowed back from that statement, possibly because it was a sweeping commitment which was made on the hoof in response to the subject being in the news, rather than being well researched policy.
If the landowner wins at the Supreme Court, it will refocus public attention on the issue, and very possibly on the wider issue of public access to the countryside. That could put pressure on Labour again to promise to pass legislation, especially if they see it as very popular with the electorate, which is likely if the general public perception is of a privileged and wealthy elite excluding ordinary people from accessing the countryside. A victory for the landowner in the Supreme Court might be just what is needed to force the issue.
