Petition to Parliament for a Presumed Liability law

Post by geomannie »

In car-centric Britain the chances of the government daring to take on the roads lobby by enacting presumed liability legislation is slim, but we can hope.

Signing this petition might persuade our politicians that they should at least try to make our roads a bit safer for pedestrians & cyclists.

Signed.

I'm a big fan of this law. I think the main reasons it still hasn't generated much support in the UK are:
a) the obvious - we have too many car brains who oppose the whole "War on the Motorist", and
b) too much confusion about what it is, and how it works. Which is a shame!

(do you have a good explainer link, mr Mannie?)

I don't see how it could be a bad thing, I used to be more in favour but I've been persuaded by the lack of evidence that it would make any difference to accident rates and there's even less evidence that these petitions have any effect.

My support for PL was bolstered during cycle tours in mainland Europe and Scandinavia where I felt my presence on the road was respected more than it is in the UK. There could be other factors in play of course!

I wonder if PL would help the cyclists case in court following a car/cycle collision where the driver claims to have been blinded by the sun in the hope of receiving a lighter penalty?

IANAL but I believe it would totally solve the cyclist's liability issues i.e. a civil claim should be a slam-dunk.

... but it would have no effect on any criminal court case.
