It is entirely plausable that Sam could not see the bump in the road. It is also possible that traffic conditions may have constrained his movement.
Checking with my Lady, who works for a Council Authority, she tells me that it is not necessarily the case that payments for such claims comes out of the Councils pot and 'robs' services. This comes under the remit of the Highways Dept, for which there should be insurance.
I am all in favour of individuals taking personal responsibility for their actions, but there has to be a limit to how far that can reasonably go and the Highways Dep't does have a duty to maintain the road.

Its also the case that council's have liability insurance that they HAVE to pay for.
Claims force premiums up, but local authorities couldn't get much higher.
The reason why our roads are in an horrendous condition is because only a tiny percentage of the public ever make a fuss and council's find it easier to pay off ( through insurance ) those that do instead of addressing the conditions of our roads.
